Hi, I'm currently waiting for the interim judgement from the court regarding my divorce. My flat has not yet fufilled its MOP of 5 years as we took the grant from HDB. Can you tell me if i will be able to sell my flat in the open market?

Morning JL,

Depending on how many years you have stayed in the unit, HDB might still allow you to sell the unit into the open market after you have recevied the final judgement. I have experienced case where divorced couples are allowed to sell their BTO that have only fulfilled 3.5 years.

With reference to your questions you have yet to receive the Final Judgement from Court and till then you can consider to sell the flat.

I believe every case is unique and HDB will analyse it on case by case basis prior to approve your selling before meeting the MOP period.

My experience over one case is that sellers are instructed by HDB to fulfill the 5 years prior to putting the unit into the open market.
