Hi. I am a SPR, my fiancé is a SC. We want to jointly buy a private property. This will be my first property in Singapore. My fiancé is having a HDB flat with his parents (jointly owned). If he is to transfer his share to a sibling, do we still need to pay ABSD? What ABSD do we need to pay if we are not yet married?

Good morning,

You have to ask your fiance to check with hdb first on whether his sibling is eligible to take over his ownership share in the hdb. If the sibling does not have any other property ownership and is eligible, your fiance name can be removed from the ownership of hdb.

Once your fiance name is removed from the ownership, and once you all get married, you all can purchase your 1st matrimonial property as married couple and no ABSD is payable as you all will be eligible for ABSD remission. ABSD remission is not applicable when you all are still at Fiance Fiancee status.

Hi Miss,

If your fiance takes his name out from the HDB flat that he owns, he is free to purchase a private property jointly with you as a married couple without having to pay ABSD.

Do take note that ABSD is payable (5% for PR's first property) if both of you purchased without getting married, and it's not refundable even if you guys get married after the purchase.

Hi,

1) Your finace is co-owner of a HDB flat. There could be SSD involved if he only became co-owner within the last 4 yrs. His sibling will also need to pay BSD for taking over the share.
His sibling must has the finance capability to takeover his share upon MSR assessment.
This transferring of share has to get HDB involve as this is not under our jurisdiction.
You may approach HDB at resale department for assistance.

2) You & your fiance will have to purchase after his transferring is complete. Otherwise, any property bought will incurred 5% ABSD and this is not refundable.
You must obtain marriage certificate before signing any S&P, this is the point where you have to declare this is your matrimonial home to avoid paying additional tax.
This is applicable to both HDB and private property.

If you are not married upon purchase (assume this is private property), you will also incurred 5% ABSD upon siging S&P, as this is not considered matrimonial home.

Good afternoon Ms,

Do take note that ABSD wont be payable if you purchase your matrimonial home with your husband not just fiance.

If you purchase as a single SPR (5% ABSD) or purchase together with him still holding on HDB (12% ABSD for second property ownership) or without HDB just as fiance (5% ABSD as you are SPR; treated as unrelated parties), ABSD will still be applicable.

Thus if you dont want to be subject to ABSD, he has to remove his ownership from the HDB. Either he can transfer to his sibling (if he/ she is eligible) if not your future in laws must be financially capable to take on any outstanding loan and return whatever CPF OA funds your fiance has utilised before.

Hope my sharing aids in clearing your doubts.

For your situation, the best outcome will be for your fiance to remove his name or transfer his share from the HDB. This can be done through the HDB branch office.

If you both get married and then purchase your first property, you will not need to pay any Additional Buyer Stamp Duty as it will be considered as your matrimonial home.
