Your only option is to appeal but judging from the response given by HDB, you are likely required to have to wait for the final judgement out with the court order in order to start selling the unit. If both you and your ex-spouse are agreeable to put forward the sale earlier than that, perhaps both of you can try appeal together but again, no one can offer to say how high a chance your appeal can be approved.

By the way, I did a few such divorce cases before and I’m happy to assist too. In this case, it would be better to wait for the final court judgment and then proceed to email the divorce document to HDB and to appeal. Most of the time, HDB would grant approval to it simply base on divorce ground in your case.

Hi Alvin,

1) You are not the first one to receive such a response from the HDB.
2) It had come to attention that there are quite a number of cases that the HDB flat is to surrender back to the HDB in a divorce case before reaching MOP.
3) The final date count of the MOP is based on the date of the final court order and the date you collected your key. If this period is less than 5 yrs, the HDB would take back the HDB at less than 80% of the market rate or even at your purchase price.
4) My guess on this is because of the delay of the BTO and the HDB has no problem looking for people to take over under the SBF especially when the HDB reset the lease to 99 yrs when the handover to them.
5) Thus if you do not want to encounter double loss (marriage and financially) thus it is advised that you time your separation so as to cross the MOP of the flat to avoid double losses.

As per HDB's reply, every appeal is assessed on a case-by-case basis. To increase your chances of appeal, you may wish to see if you have any strong supporting documents, to justify your reasons for this early waiver.
