Hi guys, I need some serious advise on this.
Some background on my situation. My current flat was purchased in 19th Feb 2019. Left about 1.5 years to MOP. My ex-wife to be and I are officially separated with the Deed of Separation signed.
I would like to check if I am allowed to appeal to HDB next year March 2023 to sell the flat in open market? What are the chances of appeal success?
Or must we finalize our divorce first before we are allowed to appeal to HDB?
Appreciate if any agents who have dealt with similar cases above can advise me please?

HDB response to my query on selling before MOP:
Dear Mr Koh
We refer to your enquiry on selling the flat before meeting the MOP.
Under prevailing HDB policies, flat owners are required to physically occupy the flat for a minimum occupation period (MOP) of 5 years before they are allowed to sell the flat on the open market. The flat owners had been made aware of this requirement as one of the conditions for purchasing the flat.
Our record shows that you purchased your flat on 12 Feb 2019 and occupied the flat for 3 years 6 months only. Hence, you are not eligible to sell your current flat on the open market at this juncture.
We would like to advise that appeal cases are evaluated on a case-by-case basis based on the merit of the case. It is still subject to approval by the relevant authorities.
