Good morning sir, if the buyer and seller already after 15 days submission to HDB for sell and buy the 3 room flat, after 2 weeks HDB approve the seller to sell the flat and done the inspection. but after 2 more weeks the buyer want to cancel for the submission don't want to buy the 3 room flat unit already. Sir, In this case ( Do the buyer can cancel or not? ) Thanks.....

Hi,

1) Since the buyer wants to cancel the deal.
2) The seller can keep the deposit and exercise fees, and look for the next buyer.
3) At the same time, the seller reserves the right to sue the buyer for the damages arising from this violation of the contract.
4) Personally, would suggest to look for the next buyer than suing. The sellers will definitely win the case, but the legal fees are going to be much higher than the damages that arose.
5) The sellers have to inform the buyers to submit an application to the HDB to cancel the transaction. The sellers must not cancel the transaction just by receiving a verbal request from the buyer.
