Hi James,

There is no problem for a person who owns private property to buy a resale HDB. However, if buying the resale HDB with a HDB housing grant or HDB loan, the rules below apply:

Applicants who are successful in getting the CPF Housing Grant are considered as having enjoyed a first flat bought directly from HDB.

They are to:
 Fulfill a minimum occupation period of 5 years.
 Wait 5 years before submitting an application to HDB for a second direct purchase flat.
 Not invest in any private property during the 5 years occupation period.
 Pay a resale levy upon selling the flat if purchasing another direct purchase flat. (Half-resale levy for Half-Housing Grant recipients).

If applicant is taking a HDB loan, he must
 not own any private
residential property in or out of Singapore for the last 30 months.

    i understand that if i purchase this resale flat with a private bank loan or cash payment, those rules do not apply. Does it mean that i will need to stay at that HDB flat for 3 years ? i am intending to put the flat for rental and live in my private property
Hello James,

yes, you may buy a resale HDB flat but you will have to do so without using CPF grant and using a bank loan instead if you intend to continue staying in your private property.

As for subletting your HDB flat, here are HDB's regulations : -

HDB Owners may sublet their flat if they have met the minimum occupation period:

1. For non-subsidised flats (flats purchased from the open market without a CPF housing grant), flat owners must have occupied their flat for at least 3 years;

2. For subsidised flats (flats purchased directly from the HDB or from the open market with a CPF housing grant), flat owners must have occupied their flat for at least 5 years.

Flat owners who meet the eligibility requirements above and who concurrently own a private property, are allowed to stay in the private property and sublet the HDB flat.
