Wait out period is 1 criteria, besides that, you will still need to fulfill the other eligibility criteria like the income ceiling and family nucleus.

To buy HDB, apart from the wait-out period after disposing of your private property (of 15 months btw, not 30 months), and assuming your transfer to a trust doesn't attract ABSD, if you are married your spouse would also have to be in the title or at least an essential occupier (which means MOP period also applies to them). Do remember that there are some costs with regard to setting up a trust as well. In addition to legal fees and potential ABSD if the person you are setting up a trust for has any property, you need to make sure the bank loan is redeemed and you have the $ (including interest) to make good the CPF) as well as money to pay for stamp duty (marginal rate has increase to 6% for properties of more than $3 mil. Basically there are a whole bunch of things and costs to consider before you go ahead and buy a HDB. Dear Sir/Mdm,

I presume you have sufficient cash to cover the relevant buyer stamp duties and ABSD needed for the transfer of this private property to a trust. The total stamp duties will be (ABSD) 65% + approximately 4% (BSD), and ABSD is required to be paid first and only refundable upon fulfilment of certain conditions set out by IRAS. For purchase via trust, it has to be on full cash basis, no CPF and loan facility is available.

Assume above is not an issue, you need to form a family nucleus with your spouse or parents to be eligible to purchase a resale HDB. For resale HDB, the wait out period is 15 months after legal completion of private property transfer, and for BTO its 30 months. Other prevailing eligibility conditions like income ceiling, no other private property, 1 singaporean also apply for BTO application.

Hi,

1) In order to gift a property to another person you have to ensure the property is free from mortgage loan.
2) For your situation, I believe that your idea of setting up a trust is because the beneficiary is under the legal age of 21.
3) Yes, it is true that you may do so in order to transfer your ownership to another person by setting up a trust.
4) However, do note that when you are buying an HDB flat. All owners and occupiers must be free from owning private property locally and overseas.
5) So if the trust's beneficiary is one of the occupiers of the flat, then you will still not be able to buy an HDB flat.
6) Back to the wait-out period. It is 15 months if you are buying a resale HDB flat. But you won't be eligible to apply for an HDB loan or grant.
7) It will be 30 months if you are applying for a BTO/SBF. In this case, you will be able to apply for an HDB loan.
8) The above is assuming that your household income ceiling has not exceeded $14k.

To be eligible for HDB ownership, you cannot own private property - and you must dispose and wait out a period of 30 months prior to HDB (BTO or SBF) application.

If you want to buy a HDB resale flat without grants, the wait out period is 15 months. Unless you are above 55 of age and buy a 4-room or smaller HDB resale flat.

There are also eligibility schemes that you must meet, and are different based on new HDB or resale HDB.

Mainly,
Citizenship - Must be Singapore Citizen, if you're SPR, you have to be married to SC, or you can only buy as a SPR couple (PR status 3 years or more)

Age - Above 21 or 35 (Public or Single)
Family Nucleus - With your spouse, or family (parents, siblings), other singles or Single

Income Ceiling - $14,000 for new HDB flats, $16,000 for EC, $21,000 for extended families.

And when you buy your private property and transfer to Trust, you'll have to pay in full cash and attract ABSD of 65% + BSD.

You may be able to get a full / partial ABSD refund (to the prevailing ownership profile) if you meet eligibility conditions
-> all beneficial owners of the property are identifiable individual
-> beneficial ownership has vested at time of property transfer, basically take effect immediately
-> beneficial ownership cannot be varied or revoked.

Basically, to be applicable for ABSD refund, you cannot get back the property by the change of trust. Read More
