Witness requirements for OTP (private condo)
Hi , what are the legal requirements for a witness for both seller or buyer when signing the OTP. I see some conflicting references but see a common statement " A witness will be required for the OTP. This can be a salesperson or anyone who is a Singapore citizen or PR, aged 21 and above. The witness cannot be involved in the transaction." Is this absolutely required or can an non Singaporean and non-PR also be a witness or will the law firm require to be corrected to comply with this requirement? Also, what does it mean by the witness not being involved in the transaction?

Hi,

Ideally the witness should be someone you trust and do not have a vested interest in having this property transaction go through successfully. To my understanding, non-citizens and non-SPRs are also ok, as long as they are 21 years and above.

As this property sale is subject to the legislations of Singapore, thus it could be more helpful to get a Singapore Citizen or PR above 21 years old to be a witness, since if the witness is a foreign person, it will be more difficult to ascertain their identity in the event of a legal dispute.

Hi,

1) Witnesses must be at least 21 years old and of sound mind.
2) Witnesses should not be related to the parties involved in the transaction (e.g., buyer, seller, or developer).
3) Witnesses must be present at the time of signing the OTP and should witness the signatures of both parties.
4) Witnesses must sign the OTP themselves and provide their full name and identification; e.g. SC or SPR ID, foreigner passport ID, etc.
5) A witness must fulfill the above criteria so as to testify in court when there is a need that the buyers or sellers (whoever they are witnessing) are not under duress and with a sound mind when signing the OTP.
