Why one of my co-owner can just hire a lawyer to help him to server his joint tenancy to tenancy in common where he just got to fill in the SLA form to convert to tenancy in common. And just need to notify the other 2 co-owner by post. Even the other 2 co-owner disagreed his convertion still valid ?

Hi,

1) According to my understanding that this change of ownership type is not possible without agreement from the co-owners.

HDB:
2) There is a specific form from the HDB to apply for a change of holding type. This form will need all owners' signatures before it can be processed.

Private:
3) The conversion of the manner of holding is done by lodging and registering the relevant instrument of Declaration with the SLA.
4) All owners will have to sign an instrument of Declaration before a Commissioner of Oaths stating your intention to hold the property as TIC or JT. If all owners agree on the conversion, they will all sign the same form to be lodged.

5) I don't think the conversion is valid without all owners' agreements.
