What happens to HDB flat after both owners pass on? If the owners' children all have their own HDB flats, can the parents' flat pass on to them? What if the children owns a condo instead of a HDB?

In my case, we have a sibling who has no house but is mentally handicapped. Can the flat pass on to him?

Good evening,

If the beneficiary of the willed HDB is also an owner of another HDB flat, HDB will require the owner to sell off one of them and decide which HDB flat that they plan to keep. As due to HDB regulations, each household is not allowed to hold on to more than 1 HDB at any one point of time.

If the beneficiary owns a private property, and the inherited HDB is bought by the deceased before 30 August 2010, the beneficiary may keep both the private property and the HDB flat. There are conditions, however:

The beneficiary must be eligible to own an HDB flat; and
The beneficiary and their family must live in the HDB flat.

As for the final scenario, it may be ideal to get legal advice on this. However to my understanding, if you have a sibling who is mentally handicapped, the donee appointed to take care of him/her may be able to assist to take over the flat on your sibling's behalf, provided the flat is willed to your sibling according to Wills Act and that your sibling is eligible to take over according to HDB regulations.

Good evening Sir/ Mdm,

Children have to sell off inherited HDB if they have HDB themselves. One family nucleus can only own 1 HDB at any point of time.

If children owns a private, they can inherit the HDB if only the HDB is a non subsidised flat bought before 30 august 2010.

You might want to clarify and confirm with HDB and/ or lawyer on the above inclusive of your sibling's condition to be eligible to inherit parent's house.

Is there a will left behind by the last parent? For rentaining the HDB that has been passed down, HDB will also require the beneficiary to be eligible to become the owner of the property. For private property owners who inherited the HDB and intend to retain the HDB, it can be done so if the HDB was purchased before 30th August 2010, and still must be eligible to own the HDB flat and must live in the HDB flat.

Your sibling who is mentally handicap can be eligible to retain the HDB if he meets all eligibility criteria, however, the transfer process is best advised by the lawyer, especially in future if there is a need to sell this property or transfer the property to another person, it will be best to look into addressing these potential considerations too.
