In this case 3 scenario might happen depending on the court order:
1) Flat returned back to HDB and HDB will determine the compensation amount
2) In rare cases, may successfully appeal to HDB for early approval to sell in the open market
3) If any party wants to take over the flat as a sole owner, he/she must have a child under legal custody, care and control as well as a parent(s) living in the same house. That party need not be more than 35 years of age as one who have a child or parent living together with them is deemed to be eligible for the public scheme. A single person could not take over a 3 Gen flat despite their age.
