WHAT HAPPEN IF THE FLAT I BOUGHT AND HALFWAY THROUGH ,SOLE SELLER PASSED ON? I HAD EVEN PAID $5,000 for the resale excerise


I am unemployed for more than a year and therefore I had sold my flat away and decided to downgrade from hdb 5 room to either 3 or 4 room HDB instead.
The completion date of selling the flat is already out. However the house i bought is currently on resale excerise and had already paid $1,000 option fees and $4,000 excerise fees but the sole owner of the flat which i want to buy had passed on.

Any kind soul can help up?? What can i do??
Understand that it will takes at least 3 months or even up to 1 year delays for the changes of onwership to the seller next of kin. But i couldnt afford renting of flats.

If cancellation, will my deposit of $5,000 forfeited in such cases??

Dear Sir,

For such a case, HDB is still able to continue to facilitate the sale even when the owner has passed on. You may want to contact the HDB officer who is in charge to seek more assistance.

Hi Philips,

1) It's a regret to hear such a situation happening.
2) If you leave it for nature to take it to cause, you may have to wait up to a year before anything could happen.
3) Because in general, under such a situation HDB has to wait for a court order to be out before they could continue with the buying/selling process.
4) Since both parties already submitted resale applications then it is obvious to liaise with the assigned HDB customer relations manager to assist in facilitating the process, i.e. withdraw from the transaction. There is no way to continue because one of the owners is unable to continue the process.
5) You may also approach your MP to assist in either withdrawing from the transaction without penalty and get back your option and exercise fees from the seller if this is beyond HDB's normal duty to cancel the resale application.
