Quite frankly, you can appoint a lawyer to go after the vendors in this case, but I am sure it is not going to help your situation on the move in dates. The more practical way could be to quickly go purchase the fixtures that were removed, settle the renovation and move in. Ultimately we want to move into our new place with positive vibes and not get embroiled in legal issues. You may disagree with my take, and take actions though. Read More

Hi there,

- If the seller has taken away fixtures that were supposed to remain, it's important to first refer to the sales agreement. Fixtures are usually considered part of the property, unless otherwise stated in the contract.
- Since you've already reached out through your law firm and agents without a response, you can escalate the issue by having your lawyer send a formal demand letter to the seller, reminding them of their obligations under the contract.
- If the seller still doesn't respond, you may need to consider taking legal action to recover the costs of the missing fixtures or seek compensation for the delays.
- In the meantime, document everything, including any additional expenses incurred due to the missing fixtures and renovation delays, as this will support your case if it escalates.

Thank you!

If your seller has removed fixtures from the house after the sale, here are some steps you can take to address the situation:

Review Your Sales Agreement: Check the sales and purchase agreement for any clauses that specify which fixtures were included in the sale. This document may outline what is considered part of the property and what is not.
Document the Situation: Take photos of the missing fixtures and gather any correspondence related to the issue. This documentation will be useful if you need to escalate the matter.
Follow Up with Your Agent and Law Firm: Since you have already reached out to your agent and law firm, it’s important to follow up persistently. Ensure that they understand the urgency of the situation and how it is affecting your renovation and move-in dates.
Consider Mediation: If you do not receive a timely response, consider suggesting mediation. This can facilitate communication between you and the seller to resolve the dispute without going to court.
Seek Legal Advice: If the issue remains unresolved and significantly impacts your plans, you may need to seek legal advice to understand your rights and potential courses of action. This could include sending a formal demand letter to the seller.
