We are new PR wanted to own a small resale HDB. There are some obstacles & we need advice. I do not own any property but my husband owns a property back in Malaysia with his ex-wife (2 names). He can't sell the property cause his ex-wife refused to sell the property. He & his ex are not in talking terms. The property is still under financing loan.
1.Can we appeal? If yes, how do we appeal?I heard some PR are successful.
2.What are the chances for us in getting a resale HDB?
3.If appeal successful, are we able to obtain 80% bank loan? Bank loan is only 60% (with outstanding loan) is that true? Are there any other options? Please help.

Afternoon Ms. Chan,

I'm not very sure of the ruling in Malaysia. As for in Singapore, divorced couples are to sell off their unit, within 6 months from obtaining Absolute. This is stated in the Court Order. Under the Muslim law, divorced couples are to settle their assets, as soon as they are offically divorced. Your husband can choice to get his ex-wife to buy over his share of the unit, back in Malaysia. Alternatively, he can choose to transfer hsi ownership to his ex-wife.
As for the appeal, unless your husband have concrete evidence showing that his ex-wife is unwilling to cooperate, in selling off the property in Malaysia, can he try to appeal the case with HDB, along with the loan issue. However, it's subjected to approval.
