We are currently the legal tenants of the flat. We have also paid the stamp duty, and the Tenancy Agreement (TA) still has one year remaining. However, the landlord suddenly terminated the registration with HDB and cut off communication with us (for example, terminating the property agent who was our only means of communication with the landlord). Currently, despite possessing a valid TA, we are not authorized to live in the flat. Any advice would be greatly appreciated.

Thank you

Hi, is there any termination clause in the TA signed between you and the landlord? Do you mean that the agent that signed your TA with the landlord is no longer serving the landlord? What did the agent say when you approach him ? As long as your stamp duty and TA remains valid, you are legally allowed to stay in the flat, you may approach me for more details and assistance if needed.

If you are in the process of a property journey be it in renting/selling/buying/investing and you are looking for someone to assist you, I will be avaliable Do reach out to me for assistance.

This situation sounds stressful and concerning. Here's some advice on how to proceed:

1. Gather Documents:

Secure copies of your Tenancy Agreement (TA), proof of stamp duty payment, and any communication you had with the landlord (emails, text messages etc.).
2. Contact HDB:

Since the landlord terminated their registration with HDB, HDB might be able to provide some guidance. Explain your situation, including the valid TA and lack of communication from the landlord. They might be able to:
Offer suggestions on how to reach the landlord.
Advise on potential mediation options.
3. Consult a Lawyer:

Given the lack of communication and the landlord's termination with HDB, consulting a property lawyer specializing in tenancy disputes is highly recommended.
The lawyer can review your TA and advise on your legal rights as tenants with a valid agreement. They can help you explore options like:
Enforcing the TA and regaining access to the flat.
Seeking compensation for the remaining lease period.
Negotiating an early termination with the landlord (if possible).
4. Singapore Mediation Centre (SMC):

The Singapore Mediation Centre (SMC) offers free mediation services for tenancy disputes: https://mediation.com.sg/.
If communication can be re-established with the landlord, mediation could be a way to reach a mutually agreeable solution.
Here are some additional points to consider:

Continue Rent Payments: While you can't access the flat, consult your lawyer about the legalities of continuing rent payments. However, keep records of all attempted payments in case it becomes necessary to demonstrate your willingness to fulfill your obligations under the TA.

Document Everything: Maintain a record of all your efforts to contact the landlord and HDB.
