Spouse and I are SPRs along with our babies. We have been SPR >3 years and intend to buy a resale HDB (no grant). Wife has a property in Malaysia occupied by parents, but we are willing to dispose it off as required.

Agent asked to declare the overseas property and mentioned we can proceed to buy resale HDB, need to dispose the Malaysian property within 6 months.

All submitted till resale application stage, now stuck here. HDB got back to us that even for 1st time SPR buyers, as long as there is an overseas property, new cooling measures apply. It has to be disposed off and 15 months waitout period applies.

We were all not aware of this and now buyer/ seller are stuck, trying to appeal. If it fails, do we as seller, lose our 5K deposit + bank penalty as loan offer was accepted?

Can we claim any damages from the agent for failing to check properly/ due diligence? Also can the buyer sue us? Thanks!

Hi,

I’m afraid that in your case, the buyer could sue you for compensation if all else fail and transaction could not be proceeded.

    We are the buyer..intent to purchase was done in June this year and no declaration was made because it was not a compulsory question..we also didnt make a new intent to buy as our agent was very sure that the new measures don't apply to us..which is why we are also stuck now.
