So my mum is a PR and i am a citizen. My mom inherited the house from my dad due to divorce 25 years back. The house was transferred to my mom only as she has my custody. I would like to ask now that i am planning to get a home of my own with my fiance, whats gonna happen? many tell me that PR cannot own a 5 room hdb flat. The current flat has been fully paid up by my father, and i was only assign as co-owner when i was 17 or 18 i cant remember, reason was due to lift upgrading, my mother doesn't want to pay the PR price for it therefor appointed me as co-owner. i understand from what i read that she has to sell the current flat and the proceeds 50-50. however, she doesn't want to sell it and wants to keep it. is this possible? will HDB still let her given this special circumstances that she was in 25 years ago?

Good afternoon Jenn,

you will have to remove your ownership from existing HDB if you intend to purchase a HDB or new EC. Therefore your mom will have to dispose current HDB off due to there's no single SPR scheme.

You can try to appeal to your HDB branch office.

If not, you can opt to purchase a private instead. Your mom still can hold on to current HDB but you will be hit by ABSD for second residential property purchase. Or your fiance buys a private under a single name.

Alternatively, sell existing HDB. You get your HDB or new EC with fiancee. Your mom gets a private.

There're many scenarios you are able to look at but perhaps you should try to appeal first.

Hi Jenn,

(1) It is true that single PR is not allowed to keep a HDB flat, other than PR divorced with child custody.
(2) Sale proceed shall deduct whatever CPF used in your mom's account. The remaining cash component will return in cheque in favour to both your mom & your name.
You can decide how to distribute it among yourself.
(3) However, there might be issue with "right-sizing" policy incurred in your case after you sell your flat and buy a flat with HDB housing loan.
Which mentioned in your enquiry of "50-50".

To move forward, the first thing you should do is to appeal to HDB to ensure your mom can keep the flat before the next move.

    Hi Ling, Thanks. the house has been fully paid , neither myself nor my mother has paid for it. The lift upgrading and HIP(toilet upgrading) has been paid by myself. Can she do the appeal herself? Since she already has a private property, she should let go of the HDB and sell it.

Hi Jenn,

It will be best to obtain an approval from HDB branch office directly.

First she is not eligible to keep HDB as a single SPR.

Secondly, there's a change of ownership thus she might be able to hold on to HDB but not private. If want to hold on to both, also need approval if so.

But since the HDB is close to 30 years old, you guys might be keen to find out whether how can you maximise its value before it starts to depreciate when it gets older.
