Separated for years - I am in the midst of a divorce and remarrying with a new spouse ( less than 35 years old with no kids).

May i know how the HDB loans works to keep the same house? would be 2nd timer here, all my cpf pour into this house already so my cpf account is quite empty (i paid more than my ex). Ex giving me the entire house with condition of his CPF full repayment to him

Hi Vivien,

1) You can still do a part-share purchase from your ex after the final court order is received.
2) You can apply for a HFE indicating you are doing a part-share purchase.
3) The HFE will calculate the new loan based on knowing the current outstanding loan you are having.
4) If the loan amount is insufficient to return to your spouse, you will have to seek help from the HDB, in such that your new spouse will buy over the share instead of you buying over.

    On the divorce papers, it was indicated that ex is transferring of his share to me & my new spouse upon full CPF refund though. May i enquire would it be Change in Flat Ownership (Not Through a Sale) or would it still be part share purchase please?

    perhaps...for the lack of better description , it would be "swapped husband name" scenario?
    I had paid 1/4 of the HDB by myself already and ex had paid the other 1/4. So the new loan would it be 3/4 of the existing price that my ex and i bought?

    would it be
    apply for HFE -> new loan tgt with partner -> CPF refund?
Have you already obtained the final judgement? If uncontested for the existing matrimonial home, you will need to ensure you have the finances to takeover the shares of your ex spouse. Whether you are eligible for HDB loan, it will be clearer once you have obtained your HFE and with your existing funds from both cash and CPF, the financing options will become clearer if the part purchase will be feasible. Is your final judgement court order already out? You need to check with the HDB branch on the feasibility to take over his share, and your finances must be sufficient to take over the loan (income wise) and refund his cpf plus accrued interest in the property.
