Question (on behalf of my close friend): I am filing a divorce with my wife (Mary). Both jointly purchased a 4 Room HDB in 2004. I paid more than 75% of the flat.

Mary has the custody of our child (John, 10 years old)

Both Mary and I are Singaporean.

I am planning to transfer the flat ownership to Mary. I want to buy a private pen-house with my girlfriend,

I am 39 and Mary is 37.

I do not need Mary to return any payment of the flat and hope that she get to retain the flat.

Please advise how I can transfer the flat ownership so that I will not be considered as owning another property.

Depending on what is stated on the court order, the necessary procedure will be carried out. However, under civil law, your wife would still need to refund your amount of CPF contribution done for the unit.

Hi

I suppose you have gotten the Final Judgement document from the court when you mentioned the child is under her custody?

You may then proceed the transfer accordingly but the cpf portion you have contributed last time will still go back to your account.

The transfer can be happened if Mary is capable to take on a loan approves by the bank/hdb, should it be needed.
