My wife and i plan to sell our current HDB(joint ownership), can we buy our next HDB (be it 1st hand from HDB or 2nd hand) with only my wife as a sole owner ? OR must one spouse be occupier of the HDB ?

hope you understand that both of you are married thus both names have to be included into the applicants either 2 owners or 1 owner while the other as essential occupier. You wont be able to buy a resale flat under one sole name.

Care to share more about your intention or thoughts so I might be able to come out with a suggestion to it?

Hi Sir,

Yes it is possible to have your wife as the sole owner and yourself as the essential occupier. An essential occupier is not considered as one of the owners and will not be able to use his CPF towards the house purchase. The essential occupier till need to observe the 5 years of Minimum Occupation Period and after which he can purchase a private property without the need to incur Additional Buyer Stamp Duty (ABSD).

HDB sees both of you as a married entity and hence both names must be included, with at least 1 owner and 1 essential occupier. This means both can't purchase another residential property for another 5 years.

Hi Sir,

Yes you could do that, by purchasing the next flat under a sole owner. Do take note that the other spouse will have to be the essential occupier of the flat.

Also, do take note that if you're taking a second HDB concessionary loan, the owner of the next flat must also pay in Cash, the amount of CPF refund amount of her spouse from the first flat, to "right-size" the HDB loan.

Both owner and occupier must also fulfill a fresh 5-year MOP before being eligible to purchase another residential property.
