Hi Mr. Wong,

Unfortunately no, for married couple they are considered one entity, hence have to purchase the resale hdb in joint names as a family nucleus. They are also required to sell off the private property after purchasing the hdb.

Hi Ken,

Yes, you can purchase the EM under one name. However, under HDB rules, the other name will still be needed as an "essential occupier" to form a family nucleus.

Also, do take note that the "essential occupier" is also bounded by the 5-year MOP period, and is not allowed to purchase a private residential property under his/her name during this period.

Afternoon,

Either one of you must be SC or both of you must be SPR for more than 3 years before you are eligible for purchase on resale HDB unit. If one of you are SC and the spouse is SPR or SC, one of you can be owner but the other must be essential occupier. If both of you are SPR, then both of you must be owners of the EM. As for the financing on your purchase, you have to settle the down payment first and clear off the balance with the fund from your condo.

Sole ownership is allowed. But you need to form a family nucleus ie. you and your wife.

Husband and wife is considered as a single entity which means both must not own private properties.

I assume you have the answer by now, however, to add on, both parties must observe the 5 years MOP for resale HDB in such case, where both are not eligible to purchase private residential properties within the 5 years period from owning the HDB.

Hi Ken,

You will be allowed to buy under one name, however, the other party will need to be an "essential occupier", not an owner but is required to form a family nucleus for HDB purchase.

"Essential Occupier" has to observed the 5 years Minimum Occupation Period which he or she is not allowed to buy another residential property. However, after 5 years, he or she will not need to pay an Additional Buyer Stamp Duty (ABSD) when buying a residential property as he or she is effectively owning 0 count of property.
