My wife and I are joint-tenancy in our 3-gen flat. We have 2 more years to go before reaching 5 years MOP.

We have listed my Mum and Dad as occupiers to meet the eligibility requirements of owning 3-gen flat. My Mum and Dad had to sell their previous flat as part of the requirements to become occupier so as to meet the 3-gen eligibility.

Now, my Mum and Dad who are in their 70s want to move out and have their own place instead of living with us in the 3-gen flat, and we do not have the finances to buy a condo for them, nor do they have the money.

My question:
1. Can I replace my Mum and Dad the current occupier with my in-law’s?
2. How can I still keep my 3-gen flat?
3. What cheap options housing are there for my Mum and Dad who are in their 70s?
4. Any more suggestion on what else can be done base on my current situation?

Hi Sir,

Based on my understanding, your parents must first fulfill the MOP before thinking of shifting out to a new place, as the MOP rule applies to essential occupiers as well. They will not be able to purchase another residential property even if they have the funds.

After meeting the MOP, they are free to purchase another property. As essential occupiers, they will not incur any ABSD on their next purchase. However, it has to be a condo. If they purchase a HDB flat, it's highly likely you will need to sell off your 3-Gen flat, as you no longer meet the requirement of owning a 3-Gen flat.

Alternatively, if you do not have the finances, you may wish to consider renting an apartment for them to stay.

The MOP applies not only to you but your parents as well since it is included in the application during purchase, thus any deviation from this arrangement has to be approved by HDB.

In the event that your in laws can be named to replace your parents, you may perhaps wish to explore on purchasing 2 room flat with short term lease with regards to housing your parents. Nevertheless, they need to have necessary funds to purchase too, if they are eligible to purchase after the assessment.
