My spouse has a hdb unit under his name before we got married. It is his childhood house that is fully paid for as his grandparent left it to him. We are wondering if we should add my name to the flat ownership as his sister also stays in the same flat and we wonder if there is contest of ownership in the event of his death. At the same time, we are also considering a condo under my name and we wonder if adding my name to the hdb has complications to the hdb and condo ownership when we count as a spouse unit.

Hi,

If you are purchasing a condo soon, you shouldn't add your name into the hdb as the 5 year MOP will apply and you can't get the condo. Also after 5 years, the condo will be considered your 2nd property since you also own the hdb and the 12% ABSD will apply.

If you are intending to purchase a condo unit soon, adding your name inside the HDB will complicate things as you won't be allowed to purchase a private property till 5 years MOP and even if you are willing to wait the 5 years period, 12% ABSD will apply by then as you will be considered owning 2nd property. To answer your concern with regards to inheritance, should your spouse pass on, the share of the flat will be distributed in accordance to his will or in the absence of will, interstate law will apply. This is assuming his sister is not named as one of the owner to the house. If his sister is named as one of the owner, I need to find out whether the house is held as joint tenancy or tenancy in common in order to advise further. Hi Mdm,

Is your husband the sole owner of the flat? Or is he a co-owner with his sister? If the flat is co-owned, it does not matter if you add your name to the flat, because his sister is also the owner.

Also, if you intend to purchase a condo, you should not add your name in the flat. This is because you will need to fulfill a new 5-year MOP, and also pay ABSD for your second property purchase.
