My partner and I (unmarried) are approaching age 35 next year. She has just disposed of a private property under her name (completion date in Nov 2023), but I do not hold any property under my name.

I am intending to purchase a resale HDB flat next year under the single scheme, after which we are intending to get married and settle into the resale HDB towards end of 2024. Is this allowed under the current regulations since neither the MOP of the resale flat nor the 15 months waiting period for her disposal of the private property is met?

Hi,

1) This is a very good question. Let's see whether you have violated any law or HDB policy in your processes.
2) You bought a flat when you reached 35 yrs old under the Single Citizen Scheme. This is perfectly alright, not violating any law or against the HDB policy.
3) You got married after purchasing the flat. Now you have to add your spouse in as an occupier after married according to the HDB policy. Note that this can be done using MyHDB portal without going down to the HDB branch or main office.
4) But your spouse had only disposed of her private property for less than 15 months.
5) You are following the law and providing updated information to the HDB.
6) So it is up to the HDB whether they allow your spouse to be an occupier of the HDB since she is not eligible to be an owner/occupier within the 15-month wait-out period after selling her private property.

The key consideration here is that you have purchased the HDB resale under single scheme lawfully, and HDB cannot stop you from getting married just because your partner have disposed off her private property within the last 15 months. What if both of you have not met each other but met only 1 month after your purchase of HDB and decided that both of you are meant for each other? Is the government going to stop you from getting married in this case? I certain guess not.

While this is definitely a technical loop hole on the 15 months window period, but I don't foresee how this is going to affect the decision to purchase, unless there is a law defining a dating couple has to date for a certain period before getting married.
