Good morning,

Sorry to hear about the unfortunate situation, I hope you are managing well. In this scenario, yes to sell the flat the final court order must be out with the matrimonial property matters finalized (be it sale on open market etc.) and they must be officially declared as divorced status.

Once so, they can purchase the 2 room flexi flat if they fulfil hdb eligiblity regulations. Have worked on similar cases before and will be happy to share the best approach.

I am sorry to hear about the current situation. For matrimonial splits, the final court order has to be obtained before the unit can be put up into the resale market. Regards to the eligiblity to purchase a 2room Flexi unit, I have extracted the following information out from HDB website:

Under the 2-room Flexi Scheme, elderly citizens have the flexibility of choosing the length of lease on their 2-room flat, based on their age, needs, and preferences. If you are aged 55 and above, you can take up a lease of between 15 and 45 years in 5-year increments, as long as it covers you and your spouse up to the age of at least 95 years. First- and second-timer families, as well as first-timer singles, can buy new 2-room flats on a 99-year lease.
