My mother's flat was sold to a couple who had bought a new condo still under construction. But the HDB application was only submitted on 30 Aug 2010, the day he new HDB policy took effect. Their appeal was rejected by HDB. Now the buyer is asking for the option and exercise fees back. Do we have to return them both the fees? Thank you.

Hi Jeannie,
In such cases it will be between the both side agreement in order to return the fees.
In fact you do not need to return the fees.
Your agent should advise and assist you on this.

    Thank you Tricia. In fact the buyers' agent, who is experienced and also from Propnex, said the sellers have to return the fees as it is not the buyers' fault that policy changes. Now the buyers' are pushing us for the return of the money. Appreciate your reply. We will decide on our next course of action.
