Hi,

It is deem as a serious offence if you falsely declare. Depending on the severity and circumstances of the infringement, HDB may issue a written warning, impose a financial penalty of up to $50,000, or acquire the flat compulsorily from the both of you if caught.

:D This question is very inappropriate to be put up here, as it is like inviting a licensed RES here to advise a consumer that is is ok not to declare out in public. As what Aaron mentioned, it is a serious offence not to declare the ownership of a private residential property overseas when you are looking to purchase a BTO. We do not know how will the authorities know or find out but are you willing to take a chance from being caught?

Hi,

1) Failing to declare the updated and provide false information will lead to an offense of providing false information to a government officer.
2) This offense is subject to a penalty of a maximum fine of up to $5,000 or 6 months jail term or both.
3) Do note that you will only be eligible to apply for a BTO 30 months later after selling the private property in Malaysia.
4) And it is 15 months later after selling the private property to be eligible for a resale HDB flat.

To be eligible, he will need to dispose off his interest of the property, and then wait out 30 months, before you're eligible to apply for the BTO flat.
