My boyfriend and i each bought a HDB resale flat 2 years ago. We are planning to get married this year and we tried to contact HDB to enquire on legalities.
We are informed to submit a request to them with a marriage certificate before they review our request.
I have questions:
1) If we want to get married, but we like to keep our name and flat individually - is it possible? Meaning i do not need to put my name in my BF's flat at all.
2) we are both still under HDB loan, can we sell one of the flats even when both flats are not yet MOP - possible? And whether there are any losses?
3) Its tough to call in to HDB, hence, we are uncomfortable to get married for certificate submission to HDB - in order for them to review our case...

Hi Louie,

As long as both of you get married, you will be required to dispose either 1 of the HDB you own. Whether or not MOP has been met, this will be the requirement. The objective of HDB is to provide affordable public housing to Singaporeans and Permanent Residents, and being married, you are considered to be starting 1 family therefore only 1 home is required.

Good morning Louie,

I understand your concerns but under HDB regulation, one family nucleus (married couple) can only own a HDB at any point of time so they would most likely require one of you sell. Seller's stamp duty might be applicable if either of your ownership period is less than 3 years. We can calculated the estimated profit or loss in the event you are required to sell either unit.

Hi Louie,

As soon as you get married, either of you will have to dispose off at least one of the HDB flats within 6 months, as you are only allowed to keep 1 HDB flat as a single family nucleus.

If you wish to sell via the open market, you will have to get special approval from HDB to sell prior to MOP. Another possibility is that HDB to repossess the flat back from you, and pay you the "market price".
