My best friend bequeathed, in his last will, his HDB flat to me and my mum in the ratio 40:60. Now that he passed away, is my mum and I able to own the flat, or do we have to sell it away?

Evening Candy,

With the probate, you can proceed with the transmission process. As to whether both of you can keep it would depend on the property ownership which both of you are having at hand. If either of you have private property but wish to keep the HDB unit, you are required to sell you private property within 6 month from transmission date. If either of you are holding onto HDB unit, you would have to choose which unit you want to keep.
