Me & my sibling had inherited a hdb from our dad but currently we are in a conflict (due to different char) & still within the 5 years new owner stay requirement.

Can one party move out / rent the room out if the 1st owner is still staying? is there any option to sell the ownership (tenancy in common) back to the 1st sibling and exit the property so that i can purchase a BTO instead? Any waiting period/penalty need to fulfil if the above is done.

Yes, you can rent out a room if one of the owners is still staying there.

As for a part-sale to your sibling, it might be slightly complicated through the 'regular' route and would depend on a number of things.

Since you’ve inherited the HDB and are still within the 5-year Minimum Occupation Period (MOP), there are strict rules:
• Moving out or renting out: You cannot rent out any part of the flat until the MOP is completed. Both co-owners must stay in the flat. Moving out yourself while the other sibling stays would breach HDB rules.
• Selling your share to your sibling: You can explore a transfer of ownership (tenancy-in-common buyout), but HDB approval is required. After transfer, the sibling who becomes sole owner must still honour the remaining MOP.
• Buying a BTO: You can only apply for a BTO after you no longer own any HDB or private property, and all MOP obligations are satisfied. If your share is sold and you exit fully, the waiting period before being eligible for BTO usually starts from the date your ownership is completely disposed.

Both of you chose to keep the inheritance under Tenancy-in-common. Currently, the rationale to move out and rent an alternative accommodation is due to "irreconcilable differences" or "severe family conflict", right?
You can write in to HDB and appeal your case, but there are multiple factors to consider:

1) Despite the successful appeal, you will need to fulfill a 30-month wait-out period before you are eligible to submit your application for BTO selection.

Hi,

1) Strictly following HDB regulations, all owners must lived in the flat until completion of MOP.
2) Failure to comply could lead to extension of MOP.
3) Doing part-share selling is not an option duirng MOP.
4) The buyer must get an approved HFE which cannot be done since under the HDB record the buyer is still within MOP.
5) The only option is to endure and complete the MOP as smooth as possible and do the part-share selling once the MOP is due.
