Me and my wife currently owns a BTO via joint-tenancy and MOP has just been fulfilled. We are considering buying another condo for investment and wondering if I can buy over or be given my wife's share of the BTO so that she can buy a condo without ABSD? Is that correct? Can we still own 1 HDB and Condo under new regulations?

Happy National Day Holidays!

Unfortunately HDB no longer allows for transfer of ownership (as depicted in your post) between married couple unless for special circumstances such as financial hardship or divorce reasons.

Since MOP is fulfilled, you can still purchase the 2nd residential property no issue, just that you will need to pay the 17% ABSD for the 2nd residential property.

Dear Thomas,

Decoupling has been disallowed for HDB since a while back therefore such an option you are exploring is not doable. In most restructuring or asset progression cases of similar scenario like yours, they will sell off their existing HDB and purchase a bigger private property for own stay and another small private property for investment through rental under sole ownership.

So what some of the clients would do would be to sell off the existing HDB flat and each will purchase a private property in order to save on the ABSD. One unit is for stay while the other to be rented out.

Hi Mr. Thomas,

1) The HDB prohibited the decoupling of HDB flats in 2016.
2) Therefore your idea of decoupling in your HDB flat cannot be done anymore.
3) You can still own 1 HDB and condo provided you are prepared to pay an ABSD of 17% on the 2nd residential property if you are a Singapore Citizen.

I regret to inform you that this is no longer possible. You will not be able to "buy over" your Wife's share of the HDB.

Having said that, there are still other ways to own 2 properties with minimal stamp fees involved.
