Me and my husband are separated(not divorced) and we have 3 kids, eldest aged 22. The ownership of the current hdb resale flat belongs to him.
Are there any options to obtain housing via BTO or any other means? Thank you

Hi,
Legally you are 'still married'. So, you cannot buy a BTO or even a resale HDB. A divorce has to take place for you to be able to buy a BTO or resale, with your kids.

Dear madam,

Am sorry to hear about the current situation. As long as you are still legally married, you have no other options to purchase a HDB flat, regardless through the resale or BTO channel. Your only option will be private residential and since you have mentioned that the current HDB belongs to your husband only, meaning you are not a co-owner of the HDB, you can purchase a private residential property without incurring any Additional Buyer's Stamp Duty as long as your finances allow you to look into this option.

Good day,

Being separated is just the process of divorce of mutual consent hence legally, both of you are still an entity. As such, you might have to wait till the final court order is out before you act.
Depending on who has custody of the remaining two children who are below the age of 21, getting a resale unit will be of better option.

Hi,

1) The only time you could apply for BTO/SBF or buy a resale flat is when you received the final court order for the divorce.
2) Under legal separation, your marriage status is still under married.
3) When comes to buying an HDB flat, a married couple is considered as a single entity implying that it is treated as one, so cannot be separated into halves.
4) There are three options that you may apply to buy an HDB flat after getting the final court order:
(a) Apply alone under the Single Citizen scheme if you are an SC at and above 35 years old.
(b) Apply with the eldest to form a family nucleus under the Public Scheme.
(c) Apply with the younger children under legal age under the Public Scheme with the full legal custody and care of the child.
