I've received an OTP and found out there is the "as is where is" clause.

What if I found out there is a defect to the property after exercising the OTP since I haven't negotiated inclusion of other clauses in the OTP, would I still be able to ask seller to rectify the defect?

Hi,

You could request for a 2nd view of the unit before paying the deposit and getting the OTP.

A typical resale transaction works this way where property is sold on a "as in where is" basis. There is no defect liability period for resale property transaction, unless of course the Vendor and Purchaser agree on these conditions of purchase before hand. I will usually advise buyers whom I am serving to arrange for a 2nd look at the property in more details before diving into an offer. Are you representing yourself in this transaction?

For HDB resale transactions, HDB will send an inspecting officer to the unit for inspection of unauthorised works and leakages/seepages before approving the resale transaction.

1) Buying a property is never a small matter, thus it is best to be cautious during viewing and offer.
2) I understand there is excitement and anxiety involved during the purchase, I come across the same emotion in all my own purchases as well.
3) This is the main reason that I had engaged an agent to assist me along the purchase process. So that he could advise me along the way which he never fails to do so.
4) If you are buying it yourself, it is never too much to request for 2nd or even 3rd view to confirm you checked through what are the important defects you should look out for.
5) You will have to accept whatever defects are in there once you exercise the OTP.
6) 2nd inspection is not for you to identify defects and request for the seller to rectify them. This is the time for you to ensure there are no damages to what you had seen before offering for the OTP.
