Is Land-Titles Landed Property based on land area as per transaction shown by URA & SLA? Is Strata-Titles Cluster Houses based on built-up or built-in area as shown by URA & SLA? Why it was not properly address to those 1st-Time buyer of Land-Titles Landed Property after they end up sueing the developer which had been a few cases?

Hi Albert Lim, it is good practice to engage a conveyancing lawyer FIRST (not a property agent). Prior to any purchase or signing of documents, you shd consult your lawyer who will be able to do legal checks, answer technical questions, vet thro your OTP or S&P. Yes this is correct; in the case of non-strata landed properties, the ownership is directly attributed to that specific land, so the definition and land is clear. The area of the land is thus stated.

In the case of strata landed, it is the entire land plot of the estate that is stratified and distributed amongst the subsidiary proprietors (ie the many owners). Each will then have a share in the common areas. As such to attribute a squarefeet area to the subsidiary ownership that includes the common areas would not be a good representation and could lead to further confusion. Thus the convention of stating only the built in area for a strata landed property. By the same token, strata condos use the same convention and do not take into account their share of the common area square footage.

Strata-Titles Cluster Houses:

These are more like condominiums with shared common property. Prices and transactions usually reference built-up or built-in area since owners own a strata unit, not the land beneath exclusively. URA & SLA data will reflect psf based on built-up area for these properties.
Why the confusion and legal cases?

First-time landed buyers often expect the landed home to be like a freehold plot, but cluster houses blur that line.

Developers or agents may not always clearly explain that strata-titled cluster homes come with shared maintenance and land use restrictions.

Pricing on built-up vs land area psf can mislead buyers on actual value.

This lack of clarity leads to disputes, sometimes ending in lawsuits when buyers realise their ownership isn’t what they expected.
