in joint-tenancy, what will happen if the flat is under court to sell due to divorce but after years the co-owner has deceased and flat remain unsold? is the court order still valid and the interest in the flat will still automatically be passed to the remaining co-owner?

Afternoon,

Having purchased the unit under joint tenancy, the Home Protection Scheme would cover for the remaining survivor, in the case of death. But under court order, both of you are no longer related, hence the requirement to sell the unit. Based on my knowledge, I doubt HPS terms will not be enforced as the legal terms are no longer fulfilled.
