I'm currently the 3rd owner of a hdb house i own with my parents. Unable to remove my name as parents are reluctant to sell the house. Can my husband purchase a hdb house separately on his own without me being a co-owner/essential occupier? He's 38 this year.

Hi Mdm,

For married couple, you are considered as a single entity and therefore when you purchase a HDB flat, both your names will need to be included either as owners or occupier. Since your name is under your parent's HDB flat, you will not be able to include your name in the purchase and therefore it is not possible. Your husband can consider getting a private property instead?

For your husband to purchase a HDB flat under his sole name, he will still be required to name you as an essential occupier.

This means that you will have to dispose off your interest in your current HDB flat co-owned with your parents.

If your parents has the financial capability to undertake the balance loan, and return the CPF monies that you had utilized towards the flat, you may wish to approach HDB branch office to withdraw your name from the current flat.

Hi,

1) Since your parents wished to keep the HDB flat. You may sell your share to them if this is feasible.
2) Under the current situation, you must be the essential occupier when your husband purchases an HDB flat since both of you are in a marriage relationship.
3) An essential occupier cannot have an interest in an HDB flat or private residential property. Interest must be disposed of within 6 months upon key collection of the purchase.
4) The other option would be for him to buy a private residential property. This will not affect your interest in the HDB flat, and he is not bound by the HDB rules to include you as an essential occupier.
