I'm 20+,single,only child and authorised occupier living with my mother(sole owner}of a fully paid 5 rm flat.Pl advise 1) Will I be the owner of the flat if she passes on without a will? 2)If yes,can I sell the flat and buy a smaller resale flat under orphan scheme if not exceeding 35 years old?Thanks.

Afternoon Amy,

If your mum is to pass on without a WILL, you will need to get a grant of probate in order obtain the necessary documents settled. The unit will eventually be yours but the procedure is more complex.

Once you have gotten the unit, you are required to fulfill the MOP and find out what other benefite you have inherited. If your mum bought the unit directly from HDB, it would be deem that you have enjoyed subsidized unit once. But if you are looking for resale unit, using bank loan, there should not be any issues.
