Is the unit under joint tenancy or tenancy in common? If it is under joint tenancy, then your brother will takeover the ownership directly. If you mother has willed her shares to you, you can still opt to let your brother takeover the property, however, in order for him to retain the flat, he needs to meet the eligibility criteria to own a HDB unit.

Hi,

If your younger brother inherits before he becomes 35 years old, technically there isn't any eligibility scheme for him to keep the unit as a single below 35 years old, so your name needs to be included. This will fall under a grey area so you and your younger brother will have to speak with the branch officer on whether they allow him to do so.

In such a scenario, if your younger brother is below the age of 35 years old, he will not be able to hold the HDB flat under his sole name. However, you may request to add your name into the flat to hold it together with him and form the family nucleus.
