Hi Jerline,

Your husband being the essential occupier regardless for HDB or EC, will still be required to observe th 5 years Minimum Occupation Period, before he is allowed to purchase another residential property. If you are taking a home loan for this property, your husband will also be unable to contribute to the repayment using his CPF since he is not a co-owner, and his income will also not be recognise for the home loan, thus you will need to ensure that the balance owners in this property is eligible for the necessary home loan for the purchase. Do take note that such changes will also require HDB's approval.

    Sorry to hear about the situation. As long as both of you are legally married, HDB will view both husband and wife as a single entity, thus MOP will still be required to be fulfilled.

    If I remove my husband as an occupier, will he still need to meet the MOP requirements? We are in the midst of filing for divorce but our BTO is almost ready. I would like to appeal for the flat.

Hi Jerline,

I don't think HDB will allow you to remove and change your husband's status to essential occupier. It is also unlikely that you will be allowed to include your Father's name into the flat too. MOP applies, irregardless whether co-owner or essential occupier.

Hi Jerline,

Any replacement of applicant will affect the eligibility status to collect the keys, hence this requires HDB approval to do so and this falls entirely under HDB discretion whether they allow such a change. You may wish to share your situation with the HDB officer to see what is the best way for this. If eligible to take over, all owners and core occupiers will need to fulfil MOP requirements, and all properties must be sold within 6 months of key collection to BTO.
