If I market my unit for rent myself, and an agent bring his direct tenant to view the unit, am I expected to pay the agent commission if the deal is closed ? If yes, how much should I pay and what service can I expect the agent to provide (eg. what kind of paper work) to me ?

Hi,

Yes, you are the landlord. If the agent brings a tenant and subsequently close the deal, you need to pay him a commission.

0.5 mth (+GST) rent equivalent for every 1year lease.

If the tenant leases 2 yr, you need to pay the agent 1 mth rent equivalent of comm PLUS GST (if the agency is GST registered).

Since you are renting it yourself, you act as agent yourself.

You need to prepare Tenancy Agreement etc.

The agent represents the tenant, he does not represent you. You should not and cannot expect anything other service from him.

CEA regulation is that the agent to Take care of the interest of his client. In this case, his client is the tenant, not you.

So you need to do all the paper work yourself.

the only other duty of that agent is to STAMP the contract.

Dear landlord,

Putting technicalities aside, being a landlord, if the tenant puts in an acceptable offer to rent your property but the issue is that the salesperson expects you to pay the commissions, will you want to pay and take in the tenant as soon as possible or reject the offer and wait for next offer which you do not need to pay commission?

Take note that as long as the salesperson collects service fees from you, he or she is expected to be taking care of your interest instead of the tenant. He or she should also not be collecting any fees from the tenants.

Hi,

it all depends on the situation. points to consider:
1. agent can seek commission from his/her own direct tenant. in this case, the agent should not be requesting for commission from you.
2. agent's tenant is NOT paying commission. in this case, agent will likely seek commission from you. if you are not open to paying commission, you may not be able to secure the tenant's deal. take it from the point of view of the agent. he/she is providing a service and that is his/her "salary". he/she will not want to work for free.

commission payable is strictly up to both parties to negotiate and agree on. a reasonable fee should be about half a month's rental for every 12 month's tenancy or part thereof.

please note that minimum required rental period in singapore is 6 months.

there are many checks and clearances that a landlord (or his representing agent) need to conduct before proceeding with the tenancy depending on the type of property that is being leased. it may save the landlord some money (initially) to avoid engaging the service of an agent to manage the marketing and tenancy of a property but a good agent will hand hold the landlord through the entire tenancy process saving much trouble and often times, money, in the long run.
