If a single is waiting for BTO HDB studio apartment , and inherits parents old HDB flat can she 1) give up the BTO studio or sell it during MOP when she has subsequently married and husband owns overseas property ?

It seems that there are several mixture of scenarios you have put up, best to check with HDB directly.

Good morning,

Usually HDB will require spouse to be included in the flat as owner or essential occupier if unit is still within MOP. Under HDB guidelines, no owner or essential occupier should own private property 30 months prior to BTO application.

So it will best to liaise with HDB for clarification so you can know what could be your next move.

1) Let's look at each scenario and its implications one by one.
2) Waiting for BTO building and inheriting parents' HDB flat before key collection:
The beneficiary has the option to let go of the BTO or sell the inherited HDB flat.
(a) The beneficiary decided to let go of the BTO, below are the payment that will be forfeited:
Option Fee: $500
Downpayment: 10% of the purchase price if taking an HDB loan
Stamp duty & Legal fees: 1% if the purchase price is below $180,000. The legal fee shall depend on the purchase price & loan: ~$250 (assuming lower than $200k) + loan less than $100k.
(b) Sell parents' flat: pay legal fee + marketing agent fee.

3) Selling during MOP most properly will be 90% of the purchase price because the HDB nowadays tends to take back the HDB (especially BTO/SBF) when required to sell before meeting MOP.
4) Married during MOP and spouse owns the overseas property. The HDB will advise the spouse to sell his overseas property within a time frame and list the spouse as an essential occupier.
5) Married after MOP and spouse own overseas property. The spouse may keep his overseas property and can be listed as an essential occupier.
