If 36F buys a resale HDB and meets a 36M who owns a condo. Does 36M need to fulfil the MOP if they get married within the 5years of 36F MOP period or after? What is the best sequence of events for both individuals to own a property each and ultimately be married together?

The understanding is that if property is purchased prior marriage and if HDB is still under MOP, the private property should be sold, however I have heard of cases where both properties were kept. Not personal encounter but only hear say. Read More

Based on the scenario you set up - Upon marriage, 36M will likely be advised to sell the condo or 36F will be advised to dispose the HDB.

Outside of trying to appeal HDB, there is only one particular sequence I can think of that doesn't require an appeal, in what you are describing at the end-state might work out within a reasonable timeframe.

Hi Karen,

Congrats on your upcoming marriage. If both properties are bought before your marriage and the HDB is still under the 5 years MOP, HDB will require you both to fulfill the MOP by staying in the HDB flat. There is usually no need to sell the private property and you may rent it out for rental income.

Current scenario

Female (36F): Buys a resale HDB under her name (single buyer).

Male (36M): Already owns a private condo under his name.

They eventually plan to get married — either within or after her 5-year MOP.

If you marry within the 5-Year MOP

The HDB will now be treated as a married couple’s property.

HDB rules state that a couple cannot own both an HDB and a private property at the same time.

The private condo owner (36M) must dispose of his private property within 6 months after being included as a spouse/owner/occupier in the HDB.
OR — the HDB owner (36F) must sell her HDB if they want to keep the condo.

MOP does not reset, but dual ownership is not allowed.

Hi,

1) Let's lay out the HDB conditions relating to your situation:
(a) All applicants (owner(s) + core occupier(s)) must not own any private residential propery during application.
(b) All owner(s) + core occupier(s) are not allowed to own any private residential property during MOP.

2) Your situation is in between the above conditions.
3) The occupier is automatically became the core occupier under married status.
4) So, whether your future spouse is going to be owner or core occupier will fall under both situation.
5) That is to say, strictly speaking your future spouse must not own any private residential property during your flat is still under MOP.
6) As for current situation, there is a 15-month cooling period before allowed to own an HDB flat.
7) The standard answer from the HDB should be both of you have to observe a 15-month cooling period before allowed to buy a resale HDB flat if married before buying.
8) If married after buying the HDB flat, your future spouse properly is not allowed to be the owner of the flat but can be the core occupier without observing the 15-month cooling period.
9) If both of you wish to keep an HDB flat and the current private residential property, then, get marry after completion of the HDB flat.
10) You may consider which is best to fit your ideal situation and appeal accordingly.
