I would like to ask the following questions about HDB.
My wife currently owns a house with her mum ( Divorcee ) and would like to purchase a New BTO/Resale Flat with me.

Is she able to transfer her ownership as per normal to her brother? For your info, her brother is above 21 years old but still hasn't start working because he is still in the NS.

Any advice would be appreciate.

Afternoon,

In the case that your wife had utilize her CPF for the unit and intend to do a transfer, it cannot materialize as your brother do not have stable income to facilitate the mortgage.

Hi,

If your wife has utilized cpf for the hdb, if she exits the ownership, the incoming owner must be able to refund her cpf utilized. Since you mention her brother has no income at the moment, I'm afraid it maybe difficult to do so. She can also transfer to her mum if her mum is financially equipped to take over.

Since your brother-in-law is above aged 21, he is eligible to be the co-owner of the HDB flat with your mother-in-law.

However, to withdraw your wife's name from the HDB flat, he will have to find ways to top up whatever CPF monies your wife has put into the HDB, and also undertake a mortgage loan on the remaining loan balance for the flat.
