I’m in a middle of a separation with my ex husband. we co own a hdb which unfortunately we did not meet the mop. But I have a boyfriend currently who wants to co own a private property with me. Is that possible?

As of now, you are ineligible to co-own another property due to your existing ownership in a HDB that has not met MOP. In the event that you have already met your MOP, you can co-own a private property if you are a Singapore Citizen, and Additional Buyer's Stamp Duty will be applicable as your 2nd property.

You are not allowed to purchase or co-own a private property as you are still under the 5 years MOP. Please do not proceed with this as there will be undesirable financial penalties if you proceed.

Hi,

1) Once you are within the MOP of an HDB flat, you will have to be obliged to the rules and regulations laid out by the HDB flat. You had signed an agreement with the HDB over this issue.
2) Thus, you are not allowed to have any ownership of any private residential property within the MOP.
3) This has nothing to do with your marital status.

Here's the situation regarding co-owning a private property with your boyfriend while separated from your husband and still owning an HDB flat in Singapore:

Challenges:

HDB Minimum Occupation Period (MOP): Not meeting the MOP on your HDB flat restricts you from buying another property (including private property) with your CPF funds.
Loan Eligibility: Banks might be hesitant to grant you a loan for a new property considering your existing HDB ownership and separation situation.
Possible Options:

Resolve HDB Flat Situation: You'll need to resolve the ownership of your HDB flat with your ex-husband before considering a new property. Options include:

Selling the HDB Flat: If both you and your ex-husband agree, selling the flat would free up your CPF used for the purchase and potentially improve your loan eligibility.
Reaching an Agreement: You could negotiate with your ex-husband to buy out his share of the HDB flat. This would allow you to keep the flat using your own CPF funds (subject to CPF eligibility) but might require a financial settlement with him.
Wait Until MOP Ends: You could wait until the HDB MOP is fulfilled before co-owning a private property with your boyfriend. This might take some time depending on when you purchased the HDB flat.
