Sorry to hear about the unfortunate news, I hope you are managing well. I assume the final judgement is out. Yes this appeal can be done and its assessed case by case basis by hdb whether they allow you to sell in open market, since there is still 5 months to go before MOP fulfilled. Are the kids going to stay with you next?

Good morning,

Sorry to hear about your situation. Even though special approval to sell within MOP is based on a case by case basis. With your court order and/ or final judgement on hand, HDB most likely will approve your appeal.

Do share with them the relevant divorce documents and inform them you are unable to stay with your ex anymore and if cant sell in resale market, where else can you sell?

Hi,

1) No one can forecast and predict a life event. Thus, it is not uncommon to sell the flat within the MOP.
2) The reason to sell is very clear. I have no idea why the HDB asked such a question.
3) The reason to sell is stated in the final court order, that you have to split the proceeds from the sale of the matrimonial home.
4) The reason to sell in the open market is because you can get a fair value from the market.

By the way, yes the appeal should not been an issue since it is only 5 months away from the MOP. I have handled a few divorce cases so far and one even got an early approval to sell despite the MOP was 2 years away. But then again the HDB appeal/ approval is on a case to case basis.
