I just got married earlier this year. Am currently staying with my wife whose house is under her name & her older sister's name (Their mother as occupier). The house was bought over from their parents after their parents divorced.

My wife & I are planning to get our own house, can we still apply for BTO/SBF? Or my wife need to sell off the house first before we can apply for BTO/SBF? Also by when do my wife need to sell the current house & what happens if the house not able to be sold off when the key collection time for the new BTO/SBF arrives?

Dear sir,

First of all, is the plan to sell off the current place and have the mother and elder sister purchase another place? Or will both the mother and elder sister take over your wife share of the HDB that you are currently staying?

Was there any grant received by your wife for this house and is she financing the property via CPF monies? If she is financing this property, then the first thing to ensure is that the mother and elder sister has the financial means to takeover the property loan, as well as refund to your wife any CPF monies used for this flat including accrued interest. If no grant has been received, then both of you should be eligible to apply for BTO or SBF, and she will only be required to dispose her ownership within 6 months from collecting the key, if there is sufficient funds to complete the purchase without selling.

Hi,

1) You need to find out whether your wife had completed the MOP from when she bought the flat.
2) Once confirmed she had passed the MOP, you are eligible to apply for BTO/SBF now.
3) Your wife can just sell her share to her sister within 6 months once collected keys for the BTO/SBF.
4) So your sister-in-law has to check whether her financial capacity is sufficient to take over the share.
5) She may apply for an HLE to determine how much loan she could get to take over the share if the current loan is under the HDB.
6) Otherwise she will have to approach the bank that they are using to check how much more she could get in order to take over the share.
