I have signed an exclusive agreement with a buyer agent. As I have found my flat, his job was to negotiate and process paper works for me. However, instead of getting the seller to decrease the price, he asked me to increase my price twice in order to match what the seller wanted.

When I asked him to get the seller to fix something in her house (so that I don’t have to incur the fee for doing so), he asked me to do it when I am doing my renovation.

I am unhappy with his service. I feel that he’s helping the seller and her agent more than helping me. Can I dismiss him? Or must I pay or keep him regardless of the kind of service he renders?

Sorry you can’t dismiss him and would have to pay the commission if you have already made the purchase.

Communication is the key in this process. Let him know your unhappiness with his performance. Things to note, to negotiate the best deal for buyer is not necessarily mean that getting the seller to decrease price, but to negotiate for the best price for buyer before buyer decides whether to increase the original offer or not. Perhaps the seller may sell to you at $500k but for other buyers, it maybe sold for $520k instead so agent would have helped the buyer save $20k in purchasing the property. In addition, all units are sold on as is where is conditions, thus if there is any defects that buyer requires the seller to fix, it should be informed upfront as part of the conditions, and not raised only after the offer has been accepted. The terms and conditions of offer should be spelt out clearly when putting in an offer.
