I have 2 elder sisters and our parents are still alive. We are all Singapore Citizens. My 2nd elder sister and I are married and has our own HDB and moved out from parents HDB. My elder sister is still single and now wants to sell away my parents HDB and buy another resale HDB. Can my 2nd elder sister and I get a share of the sale of my parents flat even our names are no longer in the flat?

Hi Martin,

You may need to work out the details with the lawyers in this scenario. Not sure the manner of holding. You and your 2nd elder sister were co-owners of the original flat together with the eldest sister and your parents?

If your parents are the owners of the current HDB flat and the 3 siblings were purely occupiers, then none of the siblings will get any share of the flat from the sale proceeds. It is up to your parents to decide on this.

Hi Martin,

Technically speaking the sale proceeds will go to the legal owners. Since your names are already removed, legally speaking you will not be entitled to a share. Definitely the more practical way will be to have an internal family discussion on what is the fairest way to bring this forward. After all it is better to do so while the parents are still around, their say will have more weight and how they want to allocate their wealth is up to them. It will be more complicated to do the discussion if they are no longer around. Just my 2 cents since this is a private family issue.

Your sister can also consider to purchase on her own sole name if she is 35 years old and above and the finances are ready. Hope the above clarifies. Only the legal owner of the flat would be receiving the cash proceeds, and it does not involve occupier.

Hi Martin,

1) There is no mention of ownership in your query. Thus I can only give general advice.
2) I would assume that this flat is jointly owned by your parents.
3) If the current situation remained unchanged till both your parents passed on. Each of you will get an equal share of the sale proceeds upon selling.
4) Your eldest sister planned to change a flat and pay with part or whole of the sale proceeds by selling the current flat.
5) Legally, if your parents buy a flat with your sister, it will depend on how they determine their ownership.
6) If they are using the joint tenancy ownership, then the survivor takes all principal shall be applied.
7) If they are using the Tenancy-In-Common ownership, your parents' share can be will according to their wishes.

Based on legal terms, you won't receive any share as you're not a co-owner.

You will need to discuss with your parents and your sisters if your parents and the elder sister are keen to purchase a flat together.

Alternatively, if your sister is 35 and above, she could find a HDB resale flat to purchase/ apply for BTO 2-rm flexi, that would make things cleaner. Read More
