I had done the sequence process that what HDB requested for surrender of HDB. Interim, Final Interim and Court Order was cater as well. HDB branch rejected my application saying that if my ex husband refuse to let the valuer come in to do the valuation, or refuse to vacant, the transaction will not be able to process. Is it my problem.... I merely follow what is requested by HDB and my lawyer and the rest is up to the HDB lawyers to do the follow up. Now I cant even buy a flat because of my name still stuck inside the current flat....Any solution to this? Appreciated and look forward for your advice.

Afternoon,

For divorce cases, both the parties must agree to sell the unit, jointly sign the necessary documents and attend both appointments to allow other things to take place. Check your court order for any specific requirement/s to make your ex-spouse do the required. Alternatively, get your salesperson to assist in the negotiation, if you have any.

Do note that your buyers have all the rights to request for compensation and specific performance since both of you have signed the OTP.

    Court order specify that he do not required to sign any doc as someone will be authorised to sign the doc on his behalf. Empower to sign by court order. HDB valuer will need to come down to give the valuation and he need to vacate the flat. My question is if he dont co-operate, will HDB still proceed on the surender? I believe HDB have their own legal dept to follow up but it also seem like HDB is pushing away the job to us to engage lawyer to do it.
