I got a tenant who rent my condo who is under 2 year lease. roughly halfway on the lease (under 1 year) i offered my condo to her for sale. because she been asking if my unit is for sale last year. suddenly she give me email which said that she already found and buy another condo also request on early termination on lease and requested her 2 month deposit back because i want to sell my condo) under my tenancy agreement there is agreement that new buyer will honor and buy the condo as in tenancy agreement (selling the condo with the tenancy as per agreement) . right on the 1 year she moved out from the condo by herself and surrender the key to my agent.
by right if tenant request early termination by herself mean the deposit will be forfeit right? however she threaten me to lawsuit and demand her full deposit back (2 month worth)

what i can do for this problem?

By the way, if your TA is a standard one with no special arrangement or agreement with the tenant, then you could jolly well ignore and to go on to forfeit the security deposit. I personally have such cases myself and I told my landlord to just ignore too. Ended up the tenant went to the small claims and tenant eventually lost the case too.

Hi,
Your ex-tenant has no case as TA is a legal document and one cannot unilaterally terminate it. If she does not want to negotiate with you, just get a new tenant. There is nothing she can do legally to recover her 2 months deposit, unless you are kind enough to offer her part of it. You are losing monies, let us not forget that!
