I am under 35 and one of my parents own a private property solely under 1 parent's name only, will I be able to form a family nucleus the other parent to purchase a HDB resale flat? Thanks!

Hi Mr. Feodor Mak,

1) The HDB ruling is such that 1 family is only entitled to 1 HDB flat.
2) Thus regardless of whether your parents bought the flat before or after marriage, as long as they are still in a married relationship. They are considered as 1 family.
3) One of your parent who might not be an owner of the flat, she/he will still consider as an essential occupier of the flat.
4) Although there are exceptions such as the 3Gen family but this type of case is quite rare, the HDB will deal with them case-by-case basis.
5) As long as your parents are in a marriage relationship, they will not be able to form a separate family nucleus with you.

Hi Mr Mak,

As HDB recognises a married couple as a single entity, whether the HDB is purchased under the husband or wife individual name, the other party will be an essential occupier of the purchased HDB, and in such scenario, the private property will need to be disposed within 6 months from purchasing the HDB flat. In addition, if your intention is to purchase a brand new HDB, there will be a wait out period of 30 months after disposing the private property before you are eligible to apply for a brand new HDB regardless through the BTO channel or SBF channel.

I regret to inform you that your parents will have to form the valid family nucleus if either of them were to purchase a HDB flat. This means that the other party will have to dispose off the private property latest within 6 months upon the HDB flat purchase.

Having said that, there may be a method where your family can still own 2 properties, a HDB and a condo. I will need to understand more from you to see if this plan is feasible.
